Swallow Incubate Co., Ltd. (hereinafter the "Company") recognizes the importance of protecting our customers' personal information. The Company complies with the Act on the Protection of Personal Information (hereinafter the "APPI") and strives to handle and protect personal information appropriately in accordance with the following privacy policy (hereinafter this "Privacy Policy").

Please note that the handling of personal information and facial images in the "Liveness Detection API Service" (a B2B API service) is governed by the Liveness Detection API Service Privacy Policy (available in English at https://bio-check.pas-ta.io/en/policy/api-privacy-notice/), which sets forth how facial images and other data submitted to the API are handled.

This Site is operated in Japan and is intended for users in Japan; the Company does not specifically target residents of other jurisdictions through this Site. Personal information processed through the Liveness Detection API Service, including for users outside Japan, is handled in accordance with the API Privacy Policy referenced above.

Definition of Personal Information

In this Privacy Policy, "personal information" means personal information as defined in Article 2, Paragraph 1 of the APPI; that is, information about a living individual that can identify the specific individual by name, date of birth, or other description contained in such information (including information that can be easily collated with other information and thereby identify a specific individual).

Purposes of Use of Personal Information

The Company uses customers' personal information for the following purposes:

  1. To receive and respond to various inquiries to the Company;
  2. To process purchases of the Company's products, arrange delivery, and provide product-related information;
  3. To provide services or products that you have applied for or registered, and to confirm and communicate the information necessary for such provision;
  4. To process purchases of paid support services, manage support cases, and communicate regarding such services;
  5. For other matters incidental to the Company's business operations.

Changes to Purposes of Use

The Company may change the purposes of use of personal information to the extent that they are reasonably deemed to have a relevant connection to the original purposes, and in such case will notify customers of, or publicly announce, the change.

Restrictions on Use of Personal Information

Except as permitted by the APPI or other Japanese laws and regulations, the Company will not handle personal information beyond the scope necessary to achieve the purposes of use without the customer's consent. However, this shall not apply in the following cases:

  1. Where based on laws and regulations;
  2. Where necessary for the protection of the life, body, or property of an individual, and it is difficult to obtain the customer's consent;
  3. Where particularly necessary for improving public health or promoting the sound upbringing of children, and it is difficult to obtain the customer's consent;
  4. Where it is necessary to cooperate with a national government organ, a local government, or a party entrusted by either of them in performing affairs prescribed by laws and regulations, and obtaining the customer's consent is likely to impede the performance of such affairs.

Proper Acquisition of Personal Information

The Company acquires personal information properly and does not acquire it by deception or other wrongful means.

Security Control of Personal Information

The Company exercises necessary and appropriate supervision over its employees to ensure the security control of personal information against risks such as loss, destruction, alteration, and leakage of personal information.
In addition, when the Company entrusts all or part of the handling of personal information to a third party, it exercises necessary and appropriate supervision over the entrusted party to ensure the security control of personal information.
The Company implements appropriate technical and organizational security measures to protect personal information.

Provision to Third Parties

Except where disclosure is permitted under the APPI or other Japanese laws and regulations, the Company will not provide personal information to third parties without obtaining the customer's prior consent. However, the following cases do not constitute provision to a third party as described above:

  1. Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purposes of use;
  2. Where personal information is provided in connection with the succession of business due to a merger or other reason.

Disclosure of Personal Information

When a customer requests disclosure of personal information in accordance with the APPI, the Company, after verifying the identity of the requesting customer, will disclose such information to the customer without delay (if the relevant personal information does not exist, the Company will notify the customer to that effect). However, this shall not apply where the Company is not obligated to disclose under the APPI or other laws and regulations.

Correction, etc. of Personal Information

If a customer requests correction, addition, or deletion of the content of personal information (hereinafter "Correction, etc.") in accordance with the APPI on the ground that the personal information is not true, the Company, after verifying the identity of the requesting customer, will conduct the necessary investigation without delay within the scope necessary to achieve the purposes of use, make a Correction, etc. of the content of the personal information based on the results, and notify the customer to that effect (if the Company decides not to make a Correction, etc., it will notify the customer to that effect). However, this shall not apply where the Company is not obligated to make a Correction, etc. under the APPI or other laws and regulations.

Suspension of Use, etc. of Personal Information

If a customer requests suspension of use or erasure of personal information (hereinafter "Suspension of Use, etc.") in accordance with the APPI on the ground that the personal information is being handled beyond the scope of the purposes of use announced in advance, or on the ground that it was acquired by deception or other wrongful means, and it is found that the request is well-grounded, the Company, after verifying the identity of the requesting customer, will suspend the use, etc. of the personal information without delay and notify the customer to that effect. However, this shall not apply where the Company is not obligated to effect a Suspension of Use, etc. under the APPI or other laws and regulations.

Disclaimer

The Company is not responsible for the standards or content of the handling of privacy information on third-party websites linked from the Company's website. Furthermore, to the maximum extent permitted by applicable law, the Company shall not be liable for any leakage of personal information from a device used by the customer, any leakage of personal information caused by use under the customer's control, or any trouble arising from an incorrect e-mail address entered by the customer in any of the forms.

Continuous Improvement

The Company will review the operational status of its handling of personal information as appropriate, strive for continuous improvement, and may amend this Privacy Policy as necessary.
